Nutzungsbedingungen – Tastemo
2. Was Tastemo leistet

Terms of Use – Tastemo
Terms of Use and End User License Agreement (EULA) for the app “Tastemo” (de.virtualart.tastetracker) for iOS and Android and for Tastemo Premium · Last updated: 18 October 2026. The German version above is the binding one; this translation is provided for your convenience.
1. Provider and scope
Tastemo is provided by Simon Theophil, VirtualART, Ostring 8, 76131 Karlsruhe, Germany, email: contact@virtualart-online.de (“we”). These terms govern your use of the Tastemo app and the Tastemo Premium subscription. Send any questions, complaints or claims about the app to this address.
Tastemo Premium is sold through the store you use the app from: Apple’s App Store or Google Play. Payment, billing, withdrawal and refunds are additionally governed by that store’s terms (Apple Media Services Terms and Conditions or Google Play Terms of Service).
2. What Tastemo provides
- Tastemo recommends films and series based on your taste, your ratings and your streaming services, and explains every recommendation.
- Free: recommendations from the shared title collection are free. New research (discoveries and newly researched titles) is limited per calendar month; the app shows the current limits. The free plan includes one private profile.
- Tastemo Premium removes the monthly limits for discoveries and new titles and allows up to five private profiles.
- To protect the service, technical limits apply to everyone, including Premium, such as a maximum number of research requests per hour. Under heavy load, research may be delayed for a while. This is not a monthly limit.
- Streaming availability comes from third parties and may change at any time. Content on streaming services is not part of Tastemo; it requires their own subscriptions.
3. AI in the background
Tastemo uses artificial intelligence in the background to research titles, summarise them and explain recommendations. Such results may be incomplete or wrong. Which AI services we use and what data they receive is described in the AI notice of the privacy policy.
4. Your account
On first launch, Tastemo creates an account without a name, email address or password. You can link it with “Sign in with Apple” or “Sign in with Google” to find it again on another device or after reinstalling. Your subscription is bound to your Tastemo account. Without a linked sign-in it cannot be transferred to a new account automatically after reinstalling.
You can delete your account in the app at any time. Deleting your account does not cancel a running subscription. Cancel the subscription in the store first (see section 5).
5. Tastemo Premium: price, trial, renewal and cancellation
- Purchase: you subscribe in the app through your store’s in-app purchase. Before you buy, the app shows the period and price; the store confirms the purchase.
- Periods: monthly or yearly. The price applies per billing period and is shown in your local currency as charged by the store.
- Trial: new subscribers can try Premium free for 1 week if the store grants it to your account (usually once, if you have never had a Tastemo subscription). The app shows the trial only when you get it. Unless you cancel before it ends, the chosen subscription starts at the displayed price.
- Renewal: the subscription renews automatically for the chosen period until you cancel. The store charges the price at the start of each new period.
- Cancellation: you cancel in the store, also directly from the app under “Account & plan” → “View Premium” → “Manage subscription in the store”. With Apple, cancel at least 24 hours before the end of the trial or the current period to prevent renewal; with Google Play, before the next billing date. Premium stays active until the end of the paid period. Whether and when you can additionally cancel early with a pro-rata refund is governed by your store’s terms.
- Price changes: the store notifies you in advance of increases for running subscriptions. Where the law requires your consent, the new price applies only if you agree; otherwise the subscription ends at the end of the current period.
- Right of withdrawal: as a consumer in the EU you have a statutory right of withdrawal. You exercise it towards the store, following its withdrawal instructions (Apple: “Purchase History” in your Apple Account; Google Play: order history). You request refunds from the store. For purchases through Apple, only Apple can refund (reportaproblem.apple.com); for Google Play, we can also refund orders.
- After it ends: when Premium expires, your profiles, ratings and lists remain; the free limits apply again.
6. Licence
We grant you a non-exclusive, non-transferable right to use Tastemo for private, non-commercial purposes on devices you own or control, as permitted by your store’s usage rules (with Apple including Family Sharing). You may not rent, resell or sublicense the app, decompile or reverse-engineer it except where the law expressly allows it, query the service automatically, circumvent limits or otherwise misuse it.
Texts, design and software of Tastemo are protected by copyright. Names and trademarks of films, series and streaming services belong to their owners.
7. Availability and changes to the app
We keep developing Tastemo and provide the updates needed to keep it in conformity with the contract. Temporary interruptions, for example for maintenance or outages, may occur. We make other changes to Premium only for a valid reason, such as new legal requirements, changes at data sources or stores, security or further development, and at no extra cost to you. If a change impairs your access or use more than slightly, we inform you in advance; you may then end the contract free of charge within 30 days (section 327r of the German Civil Code).
8. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
- For slight negligence we are liable only for breach of essential contractual obligations, meaning those whose fulfilment makes using Tastemo possible in the first place and on which you may regularly rely, and limited to the foreseeable, typical damage.
- Your statutory rights for defects of digital products remain unaffected.
9. Termination
You can stop using Tastemo at any time and delete your account in the app. We may end free use with four weeks’ notice. Both sides keep the right to terminate for good cause, for example in case of serious misuse. If we end a running subscription early for a reason you are not responsible for, you get the prepaid amount for the remaining term back: for Google Play we refund it through the store; for Apple we support your refund request, and to the extent Apple does not refund, we pay the amount back to you directly.
10. Changes to these terms
New versions of these terms apply to existing contracts only if you agree to them. We ask you in the app. If you do not agree, the previous terms continue to apply to your running subscription until it ends.
11. Privacy
How we process your data is described in the Tastemo privacy policy (German).
12. Additional terms for the iOS app (Apple)
For the app obtained from Apple’s App Store, the following also applies:
- Parties: these terms are concluded between you and us only, and not with Apple. We, not Apple, are solely responsible for Tastemo and its content.
- Licence: the licence under section 6 is non-transferable and applies to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions; the app may also be used by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support: we are solely responsible for providing any maintenance and support services for the app (contact in section 1). Apple has no obligation whatsoever to furnish any maintenance and support services for the app.
- Warranty: if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are governed by these terms and directed to us.
- Product claims: we, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.
- Intellectual property: if a third party claims that the app or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of any such claim.
- Embargo and sanctions: you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms: when using the app you must comply with applicable third-party terms of agreement, such as those of your wireless data or internet provider.
- Third-party beneficiaries: Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
13. Governing law and dispute resolution
German law applies. If you are a consumer habitually resident in another country, you keep the protection of the mandatory provisions of that country. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
